3. Sector Scope & The Annex II Direct-Only Rule

CBAM covers six sectors: Iron & Steel, Aluminium, Cement, Fertilisers, Hydrogen, and Electricity. Products are classified by 8-digit Combined Nomenclature (CN) codes in Annex I.

Direct-Only Status for Metals

Under Annex II of Regulation 2023/956, iron, steel, and aluminium goods are direct-emissions-only for financial charging. Indirect emissions from electricity are monitored and reported, but excluded from certificate charges.

Two Structural Exceptions:

  1. Sintered Ore (CN 2601 12): Retains indirect electricity emissions in its calculation. Because sinter is an input precursor, its indirect emissions flow into crude steel and downstream articles.
  2. Non-Annex II Precursors: If an Annex II complex metal good incorporates an input precursor not in Annex II, that precursor's indirect emissions must be included.

Emissions are calculated per production process within specified system boundaries.

Direct Emissions: Mass-Balance Accounting

For metallurgical facilities, tracking source streams via mass balance is standard:

Emissions = [ Carbonin − Carbonout (products, slag, off-gas) ] × 3.664

Carbon leaving the boundary in products or slag is entered as negative activity data. The factor 3.664 reflects the stoichiometric CO2/C ratio.

Complex Goods & Precursor Accounting

For downstream manufactured articles (e.g., CN 7318 fasteners), emissions roll up from input precursors:
